placing an order or making payment, you agree to these Terms and
Conditions.

These Terms are governed by the laws of Queensland and applicable
Commonwealth laws of Australia.
1. Introduction
These Terms and Conditions apply to customers and website visitors
who access our website, request a quotation, communicate with us,
purchase a product, arrange delivery or use a service provided by
Steel Box Containers PTY LTD.
Please read these Terms carefully before placing an order. If you do
not agree with these Terms, you should not submit an order, accept a
quotation or make payment.
These Terms should be read together with our Privacy Policy, Shipping
Policy, Payment Policy, GST Policy, Return and Refund Policy and any
quotation, invoice, product description, order confirmation or
written agreement issued for your purchase.
Nothing in these Terms excludes, restricts or modifies a consumer
guarantee, right or remedy that cannot lawfully be excluded under the
Australian Consumer Law.

3. Definitions
In these Terms and Conditions, the following expressions have the
meanings stated below:

hospitality and specialist container conversion projects.
5. Website Use
You must use our website only for lawful purposes and must not damage,
disrupt, interfere with or attempt to gain unauthorised access to the
website, its systems or its users.

Used shipping containers may vary in colour, markings, dents,
scratches, repairs, patches, surface corrosion, repainting, flooring
appearance and general cosmetic condition.
Customers should confirm any essential requirements before accepting
a quotation, including:

- Standard-height or high-cube configuration.
- Container condition or grade.
- Door type and door direction.
- Colour or appearance requirements.
- Refrigeration or insulation requirements.
- Modification specifications.
- Delivery access and positioning requirements.
7. Quotations and Pricing
Quotations are prepared using the information available when the
quotation is issued. Prices may depend on product type, size,
condition, availability, modifications, delivery distance, site
access, specialist equipment and applicable taxes.
- A quotation does not constitute acceptance of an order.
- A quotation may include an expiry or validity date.

Where no validity period is stated, we may withdraw or update the
quotation before order acceptance.

Stock is not necessarily reserved by requesting or receiving a
quotation.

Prices may be updated before acceptance where stock, supplier,
transport or other costs change.

Obvious typographical, calculation or pricing errors may be
corrected before an order is accepted.

We will not knowingly rely on a misleading price or require a
customer to proceed after a material pricing error is identified.
The final quotation, invoice or order confirmation will identify the
agreed product price, delivery charge, GST and other applicable
charges.
8. GST and Total Pricing
Steel Box Containers PTY LTD uses the following information:

GST may apply to taxable shipping containers, delivery services,
modifications, accessories and related products or services.
Prices presented to consumers will include GST where applicable,
unless a price is clearly identified as GST-exclusive and the
GST-inclusive total is also provided as required.
Business quotations may separately state:
- The price excluding GST.
- The GST amount.
- The total price including GST.
- Shipping and delivery charges.
- Modification or additional-service charges.
9. Orders and Acceptance
An order is not accepted merely because a customer submits an
enquiry, requests an invoice, receives a quotation or makes an offer
to purchase.
An order is accepted when we confirm acceptance in writing, issue an
order confirmation or otherwise clearly communicate that the order
has been accepted.

Once acceptance and payment are confirmed, we process the order
and arrange delivery.
We may decline an order where:
- The product is unavailable.
- The delivery cannot be completed safely.
- The quotation contains a material error.
- The payment cannot be verified.
- Fraudulent or unlawful activity is suspected.
- The customer does not accept the applicable terms.
10. Payments
Steel Box Containers PTY LTD currently accepts payment by bank
transfer.
Credit card payments may be offered as a payment option in the future
but are currently unavailable unless we confirm otherwise in writing.

Payment must be made using the account details provided on the
official invoice or written payment instructions.

Customers must use the invoice number or order reference when
making payment.

Payment must normally clear before stock is allocated or delivery
is scheduled.
- Proof of payment may be requested.

Proof of transfer does not necessarily confirm that cleared funds
have been received.

Incorrect, incomplete, reversed or unmatched payments may delay the
order.

If you receive suspicious payment instructions or an unexpected
request to pay different bank details, do not proceed until the

11. Shipping and Delivery
Steel Box Containers PTY LTD arranges shipping container delivery to
approved locations throughout Queensland, subject to transport
availability, delivery postcode, site conditions and safe access.
Our standard shipping and delivery timeframe is
5–7 days after:
- The order has been accepted.
- Cleared payment has been received.
- The delivery address has been confirmed.
- Required site-access information has been provided.
- Any specialist requirements have been agreed.
The standard flat shipping fee is
A$650 including GST for eligible standard deliveries
within Queensland, unless another charge is stated in the quotation,
invoice or order confirmation.
Additional delivery charges may apply to remote areas, regional
locations, islands, difficult-access properties, specialist lifting,
crane-assisted unloading, waiting time, re-delivery or other
non-standard requirements.
12. Site Access and Delivery Responsibilities
Customers must ensure that the delivery location is safe, accessible,
prepared and suitable for the container and delivery vehicle.
Vehicle Access
The delivery vehicle must have sufficient room to enter, turn,
reverse, unload and leave safely.
Ground Conditions
The access route and placement area must be firm, stable and
suitable for the delivery vehicle and container weight.
Overhead Clearance
The customer must identify powerlines, trees, cables, roofs,
gates, poles and other overhead obstacles.
Final Placement
The proposed container position and preferred door direction
should be confirmed before delivery.
The delivery driver may refuse to enter, unload or position the
container where the driver reasonably believes that doing so would be
unsafe or may damage people, property, equipment, the vehicle or the
container.
A failed delivery caused by inaccurate information, customer
unavailability, unsuitable access or an unprepared site may result in
reasonable waiting, storage, return-transport or re-delivery charges.
13. Risk and Ownership
Risk in the product passes to the customer after the product has been
delivered and unloaded at the agreed delivery location, subject to
any rights and guarantees that cannot be excluded under Australian
law.
Ownership of the product does not pass to the customer until all
amounts payable for the product, delivery and agreed additional
services have been received as cleared funds.
Until payment is completed, we may withhold delivery, stock
allocation, modification work or release of the product.
Nothing in this clause permits us to enter private property, seize a
product or exercise a remedy except where lawfully authorised.
14. New, Used and Refurbished Container Conditions
Container condition varies according to product type, age, previous
use, advertised grade, repairs and current availability.
New and One-Trip Containers
Generally supplied with minimal previous use and a cleaner
external and internal appearance.
Used Containers
May display dents, marks, scratches, repairs, surface corrosion,
fading, patches or repainting.
Cargo-Worthy Containers
Structurally suitable for cargo use where the required inspection
or certification is current and applicable.
Wind and Watertight Containers
Intended for general storage and protection from normal wind and
rain exposure.
Cosmetic wear that is consistent with the product description and
advertised grade does not necessarily constitute a failure to comply
with a consumer guarantee.
This does not remove a customer’s rights where a product is faulty,
unsafe, materially different from its description or otherwise fails
an applicable consumer guarantee.
15. Modified Containers and Custom Orders
Modified, customised or made-to-order products may include doors,
windows, electrical work, insulation, ventilation, shelving,
partitions, roller shutters, security features, painting or other
fabrication.
Before work begins, the customer must review and approve the relevant
specifications, drawings, dimensions, materials, quotation and
delivery requirements.
Once custom work, fabrication, sourcing or modification has begun,
changes or cancellation may result in reasonable charges for work,
materials, administration, supplier commitments and transport costs
already incurred.
Customisation does not remove consumer guarantee rights where the
product or service fails to comply with the Australian Consumer Law.
16. Change-of-Mind Cancellations
Australian law does not generally require a business to provide a
refund, replacement or exchange merely because a customer changes
their mind, selects the wrong product, finds a cheaper price or no
longer requires the product.
A change-of-mind cancellation may be considered before dispatch at
our discretion and subject to:
- The order status.
- Whether stock has been reserved.
- Whether transport has been booked.
- Whether modification or fabrication has begun.
- Whether non-recoverable costs have been incurred.
- The product’s condition and resale suitability.
A discretionary change-of-mind policy does not limit any right or
remedy available for faulty goods or services under the Australian
Consumer Law.
17. Returns and Refunds
Returns and refunds are assessed under our Return and Refund Policy,
these Terms and applicable Australian law.

Customers must contact us before arranging the return or movement
of a container.

The container should not be altered, painted, repaired, modified,
loaded, relocated or resold before the request is assessed.

Photographs, video, delivery records and other information may be
requested.

We may request a reasonable opportunity to inspect the product.

Return transport costs will be allocated according to the reason
for return and applicable law.

Modified or made-to-order products may not qualify for a
discretionary change-of-mind return.
Approved refunds will normally be paid by bank transfer to a verified
account nominated by the customer.
Nothing in this clause permits us to deny a remedy that the customer
is legally entitled to receive.
18. Consumer Guarantees and Faulty Products
Products and services supplied to consumers come with guarantees that
cannot be excluded under the Australian Consumer Law.
Depending on the transaction and applicable law, products must be of
acceptable quality, reasonably fit for a disclosed purpose, match
their description and correspond with any sample or demonstration
model.
Services must be provided with due care and skill, be reasonably fit
for their stated purpose and be supplied within the agreed time or a
reasonable time where no time is agreed.
If you believe a product or service has failed to meet a consumer
guarantee, contact us with:
- Your name and contact information.
- Your invoice or order reference.
- A description of the issue.
- Photographs or video where relevant.
- The delivery date.
- The remedy you are requesting.
The appropriate remedy may depend on whether the failure is major or
minor and may include repair, replacement, refund, repeat performance,
compensation for reduced value or another remedy required by law.
19. Warranties
Any additional warranty offered by Steel Box Containers PTY LTD will
be stated in the product description, quotation, invoice, order
confirmation or separate warranty document.
Additional warranty coverage may vary according to the product’s type,
age, condition, grade, equipment and intended use.
Unless a warranty states otherwise, additional warranty coverage may
exclude:
- Normal cosmetic wear.
- Damage caused by misuse or neglect.
- Unauthorised modifications or repairs.
- Damage caused by unsuitable placement or unstable ground.
- Corrosion caused by standing water or lack of drainage.
- Damage occurring after the container is relocated.
- Third-party or accidental damage.
- Use outside the product’s intended or disclosed purpose.
Any additional warranty operates in addition to and does not replace
rights under the Australian Consumer Law.
20. Customer Responsibilities After Delivery
After delivery, the customer is responsible for the product’s lawful
use, maintenance, security, insurance and placement.
- Keep the container on firm, stable and level supports.
- Maintain suitable drainage around the container.
- Avoid placing the container in standing water.
- Inspect doors, locks, vents and seals periodically.
- Do not overload or misuse the container.
- Arrange appropriate insurance where required.
- Obtain council, landlord or property-owner approval where needed.
- Use qualified contractors for electrical or structural work.
Customers should obtain independent advice about planning, building,
electrical, fire-safety, workplace, environmental and site
requirements applicable to their intended use.
21. Business Customers
A Business Customer confirms that the product or service is being
acquired for business, agricultural, commercial, industrial,
professional, government or organisational use.
Business Customers must assess product suitability, specifications,
compliance requirements and intended use before accepting the order.
The Australian Consumer Law may protect a business customer in some
circumstances. Nothing in these Terms excludes those protections where
they apply.
To the maximum extent permitted by law, a Business Customer must take
reasonable steps to minimise any loss arising from a product or
service issue.
22. Limitation of Liability
Nothing in these Terms excludes, restricts or modifies:
- A consumer guarantee that cannot lawfully be excluded.
- Liability for fraud or fraudulent misrepresentation.
- Liability for death or personal injury where it cannot be excluded.
- Any other right, remedy or liability that cannot be excluded by law.
Subject to those non-excludable rights and to the maximum extent
permitted by law, we are not responsible for loss caused by:
- Incorrect information supplied by the customer.
- Unsafe or unsuitable delivery access.
- Use outside the agreed or reasonably intended purpose.
- Unauthorised modification or relocation.
- Failure to obtain required approvals or permits.
- Failure to maintain or secure the product after delivery.
- Acts or omissions of an independent third party outside our control.
Any limitation or exclusion in these Terms applies only to the extent
that it is lawful, fair, reasonable and enforceable in the
circumstances.
23. Events Outside Our Reasonable Control
We will not be responsible for a delay or failure caused by an event
outside our reasonable control, except where applicable law provides
otherwise.
Such events may include:
- Severe weather, flooding, storms or bushfires.
- Road closures and transport disruption.
- Vehicle or specialist-equipment breakdown.
- Industrial action.
- Supplier or port delays.
- Government restrictions or emergency orders.
- Power, communications or internet failures.
- Cybersecurity incidents.
- Natural disasters or other emergencies.
Where an event affects performance, we will take reasonable steps to
communicate with the customer, minimise disruption and resume
performance when reasonably possible.
24. Privacy and Personal Information
We handle personal information according to our Privacy Policy and
applicable Australian privacy requirements.
Personal information may be used to:
- Respond to enquiries.
- Prepare quotations and invoices.
- Verify payments.
- Process orders.
- Arrange transport and delivery.

28. Changes to These Terms

Unless a change is required by law or agreed with the customer, the
version of the Terms in effect when an order is accepted will
ordinarily apply to that order.
We will not retrospectively impose a material change that unfairly
disadvantages a customer in relation to an already accepted order.
29. Severability and No Waiver
If any provision of these Terms is found to be invalid, unlawful or
unenforceable, that provision will be read down or removed only to
the extent necessary.
The remaining provisions will continue to apply.
A delay or failure by either party to exercise a right does not
automatically waive that right.
30. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of Queensland and
applicable Commonwealth laws of Australia.
Subject to any non-excludable right to bring proceedings in another
jurisdiction, the parties submit to the courts and tribunals with
jurisdiction in Queensland.
Nothing in this clause restricts a consumer from using a complaint,
tribunal or court process that the consumer is legally entitled to
use.
